Areas of expertise
Mark provides transparent fees relating to the number of parties involved and the amount in dispute. He offers fixed fees for all preparation and an eight-hour mediation. Travel expenses are charged at cost price plus VAT. He does not charge for travel time.
Mark joined Eversheds (then Alexander Tatham) as a trainee in 1972, retiring in 2005. In that time, his achievements included:
"Throughout my career, my work has been exclusively contentious, covering mediation, litigation, arbitration, adjudication an other forms of dispute resolution.
"I therefore have many years of experience to bring to the table, able to judge each dispute on its own merits and adopt the best approach to help everyone communicate effectively.
"Before mediation, I thoroughly analyse the paperwork in order to get to the crux of the matter as quickly as possible. Next, I aim to build rapport with the key decision-makers. I prefer to focus everyone even before the mediation, securing a level of cooperation between the parties from the beginning.
"From then on, I take a flexible and proactive approach, remaining impartial, but unafraid to offer comments and feedback where it will help. In private sessions, I am not averse to undertaking aggressive reality testing, where appropriate.
"I pride myself on bringing patience, optimism and determination to my work, as well as a good sense of humour. It gives me a good feeling to be able to help parties achieve resolution of their disputes and I am proud of my high success rate."
"Our first experience of Mark and we were impressed. He quickly grasped the legal and commercial issues and knew the parties' respective pressure points. He remained sufficiently impartial, whilst never shirking from expressing a view when appropriate. He maintained momentum throughout a long and difficult day and it ended gladly in a commercial and pragmatic settlement."
"Probably the best mediator I have had in the ten or so mediations that I have taken part in. He played the whole day perfectly. He took an evaluative approach, but not to the extent of making comments on who would win or lose the litigation"
"Without your personality and your sheer persuasiveness, I do not doubt that this matter would have trundled on, to the disadvantage of everyone involved."
"He came to the mediation thoroughly prepared and with a solid grasp of the issues. Throughout, he was calm, patient, energetic and enthusiastic, seeking always to engender a spirit of compromise."
