Fees

Mark provides transparent fees relating to the number of parties involved and the amount in dispute. He offers fixed fees for all preparation and an eight-hour mediation. Travel expenses are charged at cost price plus VAT. He does not charge for travel time.

 Professional background

Mark joined Eversheds (then Alexander Tatham) as a trainee in 1972, retiring in 2005. In that time, his achievements included:

 Examples of successful mediation cases

Mark has mediated disputes across various sectors. Examples include:

  • Construction/engineering - Four-party dispute between utility company, main contractor, subcontractor and engineer, arising out of inadvertent blocking of main sewer caused by sheet piling. Settled on the day of the mediation.
  • Professional negligence - Claim for damages against loss assessor and contractor arising out of failure to prevent asbestos contamination. Settled by payment of agreed figure split between paying parties.
  • Landlord/tenant - Dispute concerning the right of a landlord to recover substantial costs incurred in carrying out work to the building. A significant issue was whether the works should be claimed as "repairs" or "improvements", the latter being irrecoverable. Settlement achieved within the day.
  • Boundary/right of way - Multi-party right of way dispute. Settled on the basis of an agreed plan and specification for an ungraded road.
  • Company/shareholder/partnership - Dispute between two firms of solicitors arising from a partner transferring from one firm to the other. Settled before lunch.
